By accessing or using the Nemtly platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use our services.
2. Description of Service
Nemtly provides a cloud-based platform for managing non-emergency medical transportation operations, including trip scheduling, driver dispatch, route optimization, and fleet management. The service is provided on a subscription basis.
3. Account Registration
You must register for an account to use our services. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration.
4. Acceptable Use
You agree to use the service only for lawful purposes and in accordance with these terms. You may not use the service to transmit harmful content, interfere with other users, or violate any applicable laws or regulations.
5. Data Ownership
You retain all rights to the data you upload to the platform. We do not claim ownership of your content. You grant us a limited license to use your data solely for the purpose of providing and improving our services.
6. Service Availability
We strive to maintain high availability of our services but do not guarantee uninterrupted access. We may perform scheduled maintenance and will provide reasonable notice when possible.
7. Payment Terms
Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change our pricing with 30 days advance notice.
8. Limitation of Liability
To the maximum extent permitted by law, Nemtly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount paid by you in the twelve months preceding the claim.
9. Termination
Either party may terminate this agreement at any time. Upon termination, your right to use the service will cease immediately. We will provide you with a reasonable opportunity to export your data before deletion.
10. Changes to Terms
We may modify these terms at any time. We will notify you of material changes by email or through the platform. Your continued use of the service after changes constitutes acceptance of the updated terms.
